The UN/EU Dynamic in the Context of the Economic Sanctions Regime as Exemplified by the Latest CJEU Decisions

Abstract:
This paper will look at selected recent decisions by the European Union (EU) Courts on the issue of contested by individuals and entities listings pursuant to the United Nation’s (UN) Chapter VII Resolutions. The Court of Justice of the European Union’s (CJEU) attempt to balance protection of fundamental rights within their jurisdiction with the more general goal of preserving international peace and stability imposed on them by the UN Sanction Regime has inspired considerable debate. This paper will try to establish that the EU Courts’ endeavour to tackle a political problem with mostly legalistic means is a factor contributing to the difficult EU-UN dynamic.
